Sr. Counsel - Labor and Employment

JCPenney is seeking an experienced Labor & Employment Attorney to join the Company’s Legal Group.  This attorney will provide legal advice to the Company on a wide spectrum of employment matters. 
Primary Responsibilities:
  • Provide advice and counsel on matters related to Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family Medical Leave Act, the Fair Labor Standards Act, the Worker Adjustment and Retraining Notification Act, and other federal/state/local employment laws and regulations.
  • Build and maintain positive relationships with Human Resources and business clients to proactively assist with achieving business objectives in a high-volume, dynamic environment.
  • Prepare and conduct training on employment law matters.
  • Provide legal counsel and advice related to performance management and termination of employees with sensitivity to minimizing legal risks and identifying potential liabilities.
  • Draft and review employment agreements, including job offers, settlement agreements, severance documents, and waivers and releases.
  • Conduct and manage investigations regarding employee misconduct and ethics violations.
  • Represent the company in pre-litigation employment disputes, including responding to attorney letters and discrimination charges filed before the Equal Employment Opportunity Commission and state regulatory agencies.
  • Manage outside counsel as needed.
    Core Competencies & Accomplishments:
  • J.D. from an accredited U.S. law school with strong academic credentials.
  • Current member in good standing in at least one state bar.
  • 6-10 years of experience counseling clients regarding employment law issues, preferably with a large law firm and corporate legal department.
  • Extensive knowledge of employment laws and experience giving advice and counsel to HR professionals on employment matters.
  • Knowledge of California Labor & Employment and Wage & Hour laws is strongly preferred.
  • Strong communication skills, particularly drafting, negotiation and responsiveness, are required. 
  • Unquestioned ethics and integrity.
  • Strong business acumen and ability to understand business consequences of legal advice.
  • Demonstrated ability to work effectively as a member of a team, including interfacing effectively with other members of the legal department, other departments, senior management, vendors, and external partners.
