Description: The Compliance Legal Consultant is primarily responsible for assisting the Compliance Manager with the day to day operations of the compliance department’s operational activities i.e. compliance/HIPAA related activities including but not limited to management of policies and procedures; legal research; investigate and respond appropriately to inquiries, conduct training/education as well as assist with the conflict of interest procedures; provide guidance and/or oversight of federal and state laws and any other regulations affecting the District. This role may also play an integral role in assisting as needed with risk management related efforts. Typical Duties:
  1. Must have familiarity with legal and compliance related issues pertaining to hospitals, health law, contract law, general corporate, and public health and not for profit regulations.
  2. Disseminates information to educate JPS employees compliance and HIPAA related regulations that may affect or affect JPS operations via in service training, through monthly publication of Privacy Buzz, Compliance 101, and/or email updates regarding compliance related topics and laws including but not limited to Medicare and Medicaid, Civil Monetary Penalties, the Stark Law, the Anti-Kickback Statute, Health Insurance Portability and Accountability Act (HIPAA) and The Health Information Technology for Economic and Clinical Health (HITECH) Act, Emergency Medical Treatment and Active Labor Act (EMTALA), the Americans with Disabilities Act (ADA), and other regulatory or operational compliance related education.
  3. Performs compliance related research and reviews based on reported concerns of noncompliance with JPS’ policy, procedures and/or Code of Conduct, federal, state or local laws and emerging industry risks or potential risks. Communicate such research in a clear and concise manner.
  4. Works with the Compliance Manager to ensure assigned work and workload are appropriately prioritized and establish deadlines when warranted.
  5. Participates upon request or assignment by the Compliance Manager on various healthcare committees in the clinics and hospital.
  6. Develops, initiates, maintains, and revises policies and procedures for the general operation of the Compliance Program.
  7. Ability to research legal and administrative work to assist on management processes.
  8. Drafts and reviews compliance and privacy related policies and procedures as requested by management.
  9. Assists the Compliance Manager with the development and ongoing management of the Compliance and Privacy Programs.
  10. Coordinates with leadership in the implementation of corrective actions as a result of monitoring of such.
  11. Maintains knowledge of current regulations, best practices, and trends in the compliance field; serves as a compliance resource.
  12. Must possess highly developed analytical legal skills.
  13. Assists with risk management related efforts as needed.
  14. Performs other related job duties as assigned.
